PIER PERMITS

PLACEMENT OF PIERS ON WATER-SIDE RIGHTS-OF-WAY OR EASEMENTS

The cost of the pier permit is $50.00 and application may be made at the Road Commission offices.  Permits are issued on a first-come first-serve basis beginning January 1 of each year.  The following conditions are required for the issuance of a permit:

1.  One (1) pier is allowed per site, except for Eagle Lake Road, in which case piers shall be separated by 40 feet, and no permit shall be issued to a riparian owner with frontage on the body of water.

2. The permit application is to include a plan or sketch showing the pier location relative to adjacent property lines.

 3. The proposed pier, in its entirety, shall not trespass on adjoining private, underwater land, or interfere unduly  with surface use of the water.

 4. Water vessels moored on the pier shall not interfere with the safe and free use, by others, of their water vessels.

 5. No trailer or towing vehicle shall remain parked on the public right-of-way or easement.

6. The pier is, and shall remain, open and available for use by the public.

 7.  The pier permit applicant shall provide proof of insurance in the following amounts:  $500,000 Property Damage,  $500,000 Bodily Injury.

 8. The pier permit is valid from March 1 to November 1, with removal of pier required prior to November 1.

 9. If a complaint is made, and verified, as to a violation of these rules by a permit applicant, future pier permits may  be denied to that individual at that location.

10. The pier permit is issued and exists at the pleasure of the Board of Cass County Road Commissioners, and may be revoked by the Board at any time.

11. The number of watercraft moored at the pier is limited to one (1) per person or family.

This policy was adopted by the Cass County Board of Road Commission January 22, 2004 to become effective immediately.
